Terms and Conditions (AGB)

General Terms and Conditions (AGB) of Restaurant Spoerl Fabrik, the rightful operator of a GURADO voucher system.

1. General

All online orders are subject to these Terms and Conditions. Deviating and/or supplementary agreements require the express written consent of the management of Restaurant Spoerl Fabrik; this also applies to any waiver of the written form requirement.

2. Vouchers

Please note that online vouchers are issued to the customer by Restaurant Spoerl Fabrik with a tamper-proof code. As the customer prints the voucher themselves, multiple prints may be possible, but only one copy is valid and redeemable. The first voucher redeemed using the GURADO system with the corresponding code is considered the original and must be immediately debited by Restaurant Spoerl Fabrik upon redemption.

If additional copies with the same code are presented, this constitutes abuse and may lead to criminal prosecution. There is no entitlement to fulfillment and/or compensation by Restaurant Spoerl Fabrik if someone attempts to redeem multiple vouchers with the same code—even if the person redeeming the voucher first is not the legal holder. In such cases, criminal proceedings (e.g., forgery) may be initiated against the issuer acting with fraudulent intent.

Since a voucher may be transferred or gifted, Restaurant Spoerl Fabrik is neither obligated nor able to verify the entitlement of the person redeeming it. When redeeming, the system only checks whether the corresponding GURADO voucher number is valid and has been paid for.

GURADO vouchers are valid until the expiration date stated on the voucher. After this date, Restaurant Spoerl Fabrik is no longer obligated to accept them. Vouchers cannot be exchanged for cash. If the value of the voucher exceeds the amount consumed, the remaining balance can be used during future visits. Restaurant Spoerl Fabrik is not required to accept unpaid vouchers as a method of payment.

If Restaurant Spoerl Fabrik ceases operations or is forced to close for any reason, GURADO vouchers will expire without compensation. This also applies in the event of a verified change in ownership. In such cases, the original issuer (Restaurant Spoerl Fabrik) cannot be held liable.

3. Right of Withdrawal

No right of withdrawal exists for vouchers that are purchased and printed online.

4. Customer Data

Restaurant Spoerl Fabrik is entitled to collect, store, and process the personal data of customers as required within the scope of the business relationship, while taking due care in the handling of sensitive information.

5. Final Provisions

The invalidity of any individual provision of these Terms and Conditions does not affect the validity of the remaining provisions. In such cases, the invalid provision shall be replaced by a new one that comes as close as possible to the economic intent of the original. Place of performance and jurisdiction for all contracts, including these Terms and Conditions, is Düsseldorf, Germany.
